Senator Richard Blumenthal has sent letters to attorneys general in 27 states, encouraging them to proceed with their litigation against Live Nation and Ticketmaster. This initiative follows the Justice Department's recent settlement with Live Nation, which allowed the antitrust trial to resume with a federal jury. Blumenthal's efforts aim to challenge the current market structure, asserting that Live Nation's dominance as a concert promoter, ticket vendor, and venue owner stifles competition within the live entertainment industry. The ongoing legal action underscores a persistent concern about the fairness and accessibility of ticket sales for consumers nationwide.

Senate Report Exposes Alleged Ticketing Abuses

A report from the U.S. Senate Permanent Subcommittee on Investigations, led by Senator Blumenthal, claims that Live Nation has significantly influenced the escalation of ticket prices, contrary to the company's public statements. The investigation indicates that Live Nation, through Ticketmaster, leverages its market power over venues and artists to inflate fees and ticket costs. The report also details how Ticketmaster allegedly uses its dominant position in the primary ticketing market and engages in deceptive marketing tactics to push more tickets into the lucrative secondary market, ultimately benefiting from resale fees and increasing overall profits at the expense of fans.

The Senate report further criticizes Live Nation's practices, citing specific instances where Ticketmaster allegedly encouraged artists to make tickets available for resale even before public sales, driving up prices. Internal documents and executive communications reviewed during the investigation purportedly reveal a deliberate strategy to expand dynamic pricing, leading to a more than 700 percent increase in dynamically priced tickets for North American concerts between 2019 and 2022. Despite Live Nation's claims that artists and venues control pricing, the report suggests that Ticketmaster retained significant control over ticket allocation and pricing, including the use of "Platinum pricing," which significantly boosted revenue, as evidenced by a 94 percent increase in revenue for certain concert series using this model.
