In an evolving digital landscape, the Motion Picture Association (MPA) and ByteDance have forged a significant alliance, establishing a critical framework for intellectual property protection within generative artificial intelligence. This partnership underscores a proactive approach to managing the complexities introduced by AI's rapid advancements in content creation.

Safeguarding Creativity in the Age of AI

A Pivotal Agreement Between Industry Giants

The Motion Picture Association and ByteDance have officially confirmed a collaborative framework designed to secure the intellectual property of the film and television sectors. This initiative specifically targets ByteDance's array of generative AI applications, including prominent AI video and image generators like Seedance and Seedream.

Addressing Prior Concerns and Establishing New Standards

This cooperative effort emerges months after the MPA issued a formal cease-and-desist to ByteDance. The prior action was prompted by the release of Seedance 2.0, an AI model that allowed users to create content featuring likenesses of well-known actors, such as Brad Pitt and Tom Cruise. The MPA had previously criticized the company for what it described as a widespread disregard for established copyright laws essential to protecting creators' rights and sustaining numerous American jobs.

Evolving AI Models and Collaborative Engagement

Following extensive discussions, both parties reached an understanding to implement robust IP safeguards within ByteDance’s AI platforms. This progress is evidenced by the recent updates to Seedance 2.5 and Seedream 5.0 Pro. These updated generative tools are accessible across ByteDance's diverse suite of applications, including TikTok, its U.S. counterpart, CapCut, and Dreamina.

Commitment to Copyright and Responsible Innovation

Charles Rivkin, Chairman and CEO of the MPA, emphasized the association’s conviction that copyright forms the bedrock of the entertainment industry. He reaffirmed their dedication to protecting creative content, highlighting the constructive dialogue with ByteDance that led to the implementation of significant protective measures for Seedance and Seedream. This memorandum of understanding signifies a mutual resolve to continually reinforce these safeguards.

Navigating the Future of Generative AI in Entertainment

This development reflects the entertainment industry's ongoing efforts to reconcile the transformative potential of generative AI with the inherent risks it poses, particularly concerning unauthorized use of intellectual property and likenesses for training AI models. The MPA has previously taken a firm stance against other AI models, such as OpenAI’s Sora, before similar protective measures were adopted.

ByteDance's Stance on Intellectual Property

John Rogovin, General Counsel for ByteDance, articulated the company's respect for the intellectual property rights crucial to creative industries globally. He stressed ByteDance’s belief that responsible AI innovation must inherently include meaningful protections for rights holders. Rogovin acknowledged the productive engagement with the MPA and its members, reinforcing their commitment to enhancing safeguards across their generative AI services and establishing a vital framework for future collaboration as the technology advances across various products and platforms.
